chile ha resuelto un asunto de gran interés teórico y práctico relacionado con el rechazo de una solicitud de patente de invención de procedimiento antes concedida en tres registros distintos ee uu canadá y aripo la sentencia se relaciona con el requisito de fondo de patentabilidad denominado nivel inventivo art 32 y su apreciación por la sana crítica así como con cuestiones relativas a la bilateralidad de la audiencia en el proceso de discusión pericial y la fuerza del informe del perito en la resolución administrativa que resuelve las concesiones de patente estableciendo finalmente la inexigibilidad de la producción de un efecto sorprendente de la solución técnica así exigido en la práctica por los informes periciales y resoluciones incluso del tribunal de propiedad industrial como un elemento ajeno al estándar legal de la altura inventiva se estimaron vulnerados los artículos 7 16 y 35 de la ley de propiedad industrial de chile 19 039 en efecto la sentencia resuelve que el artículo 35 de la ley 19 039 dispone que para determinar si una invención tiene nivel inventivo se debe considerar si para una persona normalmente versada en la materia técnica correspondiente ella no resulta obvia ni se habría derivado de manera evidente del estado de la técnica esto significa que el nivel inventivo corresponde a una determinación subjetiva que debe realizar el sentenciador sobre la base de un criterio objetivo cual es la perspectiva de una persona normalmente versada en la materia técnica correspondiente y de acuerdo al nivel de conocimiento existente a la fecha de la prioridad y no aquél al que hubiere evolucionado a la fecha de análisis pericial de esta manera el tribunal de propiedad industrial de segunda instancia con el fallo impugnado ha infringido el artículo 16 de la ley n 19 039 con influencia sustancial en lo dispositivo del fallo en razón de que la errada apreciación de los antecedentes del proceso produjo la contravención formal del artículo 35 de la cita ley pues se ha procedido a negar el registro de una solicitud aplicando y exigiendo acreditar para determinar el nivel inventivo una categoría que van más allá de lo que requiere la ley el efecto sorprendente la corte suprema casando el fallo de instancia resolvió además que los jueces al resolver el asunto controvertido deben ponderar el informe pericial el que constituye un antecedente más de aquellos que se deberán valorar es decir la ponderación debe serlo de manera global abarcando todos y cada uno de los antecedentes allegados ajustada a criterios de racionalidad y de la experiencia que consideren el valor conjunto de todos ellos y no solo de uno o algunos de manera que permitan resolver adecuadamente el asunto así al considerar únicamente las razones técnicas dadas por el perito para concluir que la presente solicitud de invención carece de nivel inventivo omitiendo toda consideración a los principios de la lógica y las máximas de la experiencia que correspondía aplicar prescindiendo en su análisis de los elementos de convicción que estaban llamados a valorar han infringido las normas que gobiernan el sistema de ponderación judicial de la prueba que dispone el artículo 16 de la ley 19 039 además los jueces de la instancia desatendieron el principio de bilateralidad de la audiencia audiatur altera pars alegado por el solicitante recurrente en cuanto a que se vio impedido de ejercer su legítimo derecho a formular las observaciones que resultaban pertinentes sobre la materia ya que no se le otorgó el traslado respectivo del referido informe pericial infringiéndose de esta forma lo dispuesto en el artículo 7 de la ley finalmente el fallo nos recuerda que si bien los jueces de la instancia son soberanos al establecer los hechos no es procedente aceptar que en tal análisis puedan prescindir de elementos de convicción que están llamados a valorar pues al hacerlo así desde luego infringen las reglas de la sana crítica la sentencia que puede considerarse de escuela entró a conocer del fondo del asunto mediante el expediente de la infracción de leyes reguladoras de la prueba en este caso regidas por la sana crítica estableciendo varios principios que es bueno recordar el procedimiento de concesión de patente es un procedimiento administrativo que deviene en judicial especial al momento de trabarse una controversia entre el solicitante y la administración y está íntegramente regulado por el principio de legalidad los informes periciales contienen dictámenes técnicos que junto con otros antecedentes del proceso en este caso documentos de patente y registros previos configuran los elementos de convicción del registrador que obra como juez especial quien debe ponderarlos de acuerdo con el estándar de la sana crítica exigencia que se hace extensiva al tribunal de propiedad industrial por su parte el estándar legal contenido en los requisitos de fondo novedad nivel inventivo y aplicación industrial son los únicos a los que se debe recurrir tanto por los peritos como por los sentenciadores para acoger o rechazar un derecho de exclusiva de esta clase estimando al ya conocido efecto sorprendente como una exigencia ilegal más allá que se trate de una interpretación del concepto jurídicamente indeterminado persona normalmente versada en la materia técnica esta última expresión es un ideal abstracto tal como el buen padre de familia que sirve de referente para el evaluador técnico y el resolutor que en la práctica chilena ha devenido en la exigencia de la producción en el evaluador de un efecto sorprendente por parte de la realización respectiva como una forma de medir la falta de obviedad de una determinada realización su utilización en consecuencia ha sido considerada por la corte suprema como ilegal
