ask rowse takes a close look at dutton s 15 questions on the voice and where various public figures stand on the question of the detail then there s the design of the voice itself labor insists that this discussion be deferred until after the referendum when parliament will consider a yet to be written bill others want to start the design conversation now even those on the right who want to see the referendum carried people like legal scholar greg craven liberal mps julian leeser and andrew bragg and journalist chris kenny have either raised questions about the shape of the voice or asked for the government to publish a draft bill the essay is well worth reading rowse presents the most erudite explanation of the bipartisan tumult that i have encountered he attends to the essence of dutton s strategy to expose labor s crash or crash through approach dutton undoubtedly profits by continuing to ask questions about voice design he can avoid alienating liberals who want a constitutionally enshrined voice while keeping at bay the liberals who for a variety of reasons would like to join the nationals in the no camp but characterising his questioning as a political tactic significant that dutton s fourteenth question linked this ethically attractive idea to an actual design proposal will the government commit to local and regional voices as recommended in the report on the co design process led by tom calma and marcia langton the power broker it should be crystal clear to anyone who has read the proposed amendment put forward by the prime minister that the only thing australians will be asked to approve or reject at a referendum is the establishment of an aboriginal and torres strait islander voice voice to parliament will be able to evolve and adapt without set model in referendum paul garvey quoting mark leibler in the australian 18 december 2022 mark leibler is known as a power broker that is the title of his authorised biography he has had access to parliamentarians and prime ministers for more than four decades as a leading zionist and a robust negotiator he is regarded as a controversial figure by some critics as a supporter of reconciliation he is held in high regard by senior indigenous campaigners like noel pearson marcia langton and pat dodson he has worked along side key campaigners like pat anderson and tom calma leibler was appointed to the inaugural board of reconciliation australia in 2000 and in 2005 became co chair holding the position until 2011 in 2010 he was appointed to the position of co chair of the expert panel on constitutional recognition of aboriginal and torres strait islander peoples in 2015 leibler was appointed as co chair of the referendum council on constitutional recognition of aboriginal and torres strait islander australians when it was created under the bipartisan efforts of prime minister malcolm turnbull and leader of the opposition bill shorten leibler welcomed the publication of the co design final report in december of 2021 and in an interview with paige taylor from the australian provided statements on the way forward which suggest that based on submissions to the co design consultations constitutional enshrinement of the voice could be informed by the co design report despite its focus on a legislated voice we have their recommendation that the government should note the overwhelming support in the community for constitutionalising the indigenous voice we have work proceeding immediately on the local and regional voices to give aboriginal and torres strait islander australians input into not only federal policy but also state territory and local policy making and for those of us who believe that enabling legislation around the national voice should be developed now but only passed subsequent to a successful referendum that door remains open paige taylor notes that the co design report does not comment on how the voice should be protected either in legislation alone or in the constitution and points out that an overwhelming number of people who attended public meetings and wrote submissions during the public comment period said they wanted it to discovered during the series of lectures that the course was designed for political realists unfortunately i am a political idealist and unlike most of my fellow students i was not currently in a public service role my studies were not undertaken as part of a workplace professional development program i dropped out of the course when i realised that the document that was offered as a framework for developing a policy implementation plan indicated that the work of developing plans of that nature is collaborative involving multiple teams and working across disciplines my fellow students and i were tasked with doing alone something that is by its nature an iterative process my fellow students may have had the benefit of consulting work colleagues a friend of mine a public servant who had engaged with policy at every stage from implementation planning to delivery including evaluation and monitoring said the assignment task was an exercise in worst practice he said that sometimes public servants have to act individually to fake an iterative process to generate plans that satisfy higher ups the document offered as a framework is the one quoted above it was published in 2014 8 years before it was presented to myself and my fellow students i made enquiries with the department of prime minister and cabinet and discovered that the cabinet implementation unit no longer exists i could not find the contemporary equivalent of the 2014 document i was incensed at having acquired debt through being enrolled in a course that appeared to be designed for in service public servants it was my cv rather than my academic record that secured my place in the course my cv makes clear that i am a political realist while i failed the course i learned some key lessons about policy implementation planning as an iterative process and how policy implementation is always vulnerable to shifts in political will we were taught that shifts in the political will that compromise good policy are called wicked problems i recognised during the public discourse on the detail of the voice that there appeared to be two positions held by referendum working group members the detail is there in the co design report or we don t need the detail because it s a vote on principles it became clear to me that constitutional enshrinement was an attempt to knock the wicked problem of evaporation of political will on the head the voice was not presented labor and some members of the referendum working group as a policy proposal but rather as a moral imperative despite its implementation being the subject to the same kind of planning as any other significant policy i would argue that fostering a culture of collegiality in the sphere of constitutional enshrinement is extraordinarily difficult because the public are active stakeholders i would argue that there is no room for stage managing processes and masking of very real divisions for the sake of maintaining a united front i would argue that the public could sense that labor were not acting in good faith i think they could see that claims the detail was all there were not backed up by the output of the referendum working group the public didn t need to monitor the communiques to sense that the promises of more detail were not being fulfilled the public record it appears that design principles that constitute the sum total of the voice detail were agreed upon by the referendum working group at its first meeting 29 september 2022 but not revealed to the public until 23 march 2023 when the referendum question was announced linda burney s 21 october 2022 evatt lecture occurred after the first meeting of the referendum working group and before its second meeting on 28 october 2023 the design principles were first mentioned on the public record in the communique for the 12 december 2022 meeting for my purposes the public record consists of the formal statements arising from the referendum working group as laid out in its terms of reference and statements and documents associated with the media conference announcing the referendum question and design principles on 23 march 2023 statements by individual referendum working group members and labor politicians that the co design report contains the detail do not reflect the consensus position of the referendum working group in effect the detail of the voice offered to the public was agreed upon in september 2022 but not released until march 2023 a period of nearly 6 months during that period the arrival of more detail was either promised or suggested given that the design principles had already been articulated in the uluru statement codified in the joint select committee and expanded upon in the co design process the idea of more detail should satisfy the commitment embedded in the terms of reference under the title scope and purpose the information on the voice necessary for a successful referendum while the nature of the necessary information for success is contestable it can be argued that the public was not satisfied or convinced by information detail that was offered i would argue that if the communiques had stated explicitly that the referendum working group had discussed the co design report in terms of implementation and that there had been differing opinions on the relevance and utility of that report among working group members the media would have been given the opportunity to unpack the issue for the public the authority conferred by the communiques as objects of the
