made up of a team of two by creating an account or using atelier you agree to them if you don t agree don t use the service 2 atelier is in beta this is the part we would most like you to actually read atelier is unfinished software offered while it is still being built that has real consequences features may change move or be removed without notice bugs may cause data to be lost corrupted or displayed incorrectly the service may be unavailable sometimes without warning we may need to reset data migrate it or in the worst case rebuild part of the database from scratch please keep your own copies of anything important settings support account data export my data will give you a full copy of your content at any time and we recommend using it periodically we will do our best to avoid losing your work but during beta we cannot guarantee it and we would rather say so than imply otherwise 3 who can use atelier you must be at least 13 years old to use atelier by creating an account you confirm that you are if you are under the age of majority where you live you additionally confirm that a parent or guardian has agreed to these terms on your behalf we do not ask for your date of birth and we do not verify age that means this is a promise you are making to us not something we check if we learn that an account belongs to someone under 13 we will delete it where atelier is available atelier is offered to people in the united states it is not offered in the united kingdom or the european union it is not aimed at anyone there and memberships cannot be bought from there we do not block the site by location that would shut out americans travelling but if you are in the uk or the eu atelier is not being offered to you 4 your account you are responsible for what happens under your account and for keeping access to it secure tell us at support atelierjournals com if you believe someone else has got into it during beta access begins with an invite code entering a valid code lets you create an account until you attach a google sign in that code is what reaches the account so treat it as private attaching a google sign in from settings ties the account to you alone and retires the code which stops working from that point on we strongly recommend doing so one person one account don t share an account with someone else and don t create accounts to get around storage limits invite limits or a suspension 5 what you write is yours you keep full ownership of everything you put into atelier we claim no ownership of your entries your photos or anything else you create to actually run the service we need your permission to do a narrow set of technical things with that content store it back it up transmit it between your devices display it back to you and show it to the specific people you choose to share it with that permission is limited to operating atelier for you it is not exclusive and it ends when you delete the content or your account to be explicit about what this permission does not include we will not publish your content sell it license it to anyone else use it in marketing or use it to train machine learning models feedback and suggestions feedback is different from the things you write for yourself if you send us a bug report a feature idea or a suggestion through the in app feedback form or any other way we may use it to build and improve atelier without owing you payment or credit and we may do so even if we were already working on something similar we are not taking your journal we are just making sure that acting on a good idea does not create a claim against us feedback you send is not anonymous to us it arrives attached to your account and our privacy policy explains why 6 what is ours atelier itself belongs to us the software the name the design the artwork and the writing on these pages using atelier gives you permission to use the service it does not give you a copy of it that permission is personal to your account and lasts as long as you keep to these terms so please don t resell or redistribute atelier take it apart in order to rebuild it somewhere else or put our name or our design on something that isn t ours one honest caveat because the opposite claim appears in a lot of terms and is not true of any website your browser has to receive atelier in order to run it so you can read how it works that is how the web functions and we are not going to pretend otherwise what we ask is that you don t take it and ship it as your own none of this touches section 5 what you write stays yours 7 acceptable use don t use atelier to break the law or help anyone else break it harass threaten or abuse anyone including through shared boards journals or comments upload content that sexualises minors incites violence or that you have no right to upload attack probe or overload the service or attempt to reach accounts or data that are not yours scrape or bulk extract data or run atelier through automated clients resell or redistribute the service we may suspend or remove accounts that do these things where it is reasonable to do so we will tell you why first 8 copyright complaints if you believe something on atelier infringes a copyright you hold write to support atelierjournals com with copyright in the subject line please tell us what work you own where the material is on atelier and how to reach you and include a statement that you believe in good faith the use was not authorized and that what you have told us is accurate we read every notice we receive where a complaint is well founded we will remove or disable the material and we will tell the person who posted it what was removed and why if your material was taken down and you think that was a mistake write to the same address and we will look again we may suspend or terminate accounts that infringe repeatedly 9 sharing with other people when you share something you are responsible for what you share and who you share it with content shared with you belongs to the person who wrote it treat it accordingly and don t redistribute it without their say so we do not read or moderate private journals boards or comments that is deliberate they are yours but it does mean we will not notice a problem unless someone tells us about it you can block someone from settings blocking takes effect immediately it removes them from your friends list cancels any pending request from them hides everything they had shared with you and revokes their access to anything you had shared with them blocking is one sided and silent we do not tell the person you blocked you can unblock them at any time though sharing that was revoked is not restored automatically and the friendship is not re established if someone is harassing you or is using a shared journal or board for something that breaks section 7 report it to support atelierjournals com tell us what happened and where to act on a report we may need to look at the specific shared content it concerns and we may warn suspend or remove the account responsible 10 limits atelier has a free plan and a paid membership the free plan is permanent it does not expire into a trial but it is capped most of those caps are enforced on our servers rather than only in the app the photo count and the higher pinboard allowance for members are applied in the app on the free plan you can keep 3 projects 5 habits 3 pinboards 30 library entries and 20 photos journal entries are unlimited four palettes and two of the five scenes are included the rest are a membership feature a membership raises pinboards to 20 and lifts the other caps founding members are not held to the per studio caps at all they keep whatever combination of projects habits library entries and photos fits within their storage allowance with pinboards capped at 20 as for members uploads are capped at 100 mb per account on the free plan and 1 gb for founding members with a limit of 10 mb per individual file members have a ceiling of 3 gb which exists to prevent bulk file storage rather than to ration what you keep and we raise it on request free and founding accounts can see how much room they have used in settings support these ceilings are a safeguard against atelier being used as bulk file storage not a ration on what you keep if you reach yours through ordinary use write to support atelierjournals com and ask us to raise it we raise it for ordinary use as a matter of course we may decline where the space is being used as general file storage which is the thing the ceiling exists to prevent until it is raised further uploads are refused nothing you have already uploaded is removed or altered what happens if you go over every limit is a soft wall storage stops further uploads the other limits stop you creating anything new in that category nothing you have already made is deleted to bring an account back within a limit if a limit is lowered or an account moves to a smaller plan what is already there stays and simply cannot be added to we still ask you to keep your own copies settings support account data export my data these limits do not apply during the beta everyone has full access until 1 march 2027 and they begin to apply from that date the figures may change as we learn what the service actually costs to run if we reduce them we will give you notice and time to export or trim what you have 11 membership and payment some features require a paid membership which the app calls atelier pro payment is handled by stripe on stripe s own pages we never see or store your card details free trial new memberships start with a 10 day free trial you give stripe a card when you start it nothing is charged during the trial and the first payment is taken automatically when it ends unless you cancel before then canceling during the trial costs you nothing a trial is tied to your email address rather than to the account if you delete your account and sign up again with the same email you continue whatever time was left rather than getting a fresh ten days memberships renew automatically until canceled you can cancel at any time from settings and cancellation takes effect at the end of the period you have already paid for you keep access until then prices may change and we will give you notice before a change affects a renewal what renews and how to stop it a membership renews automatically at the end of each period monthly plans monthly annual plans annually at the price shown when you subscribed charged to the card you gave stripe it keeps renewing until you cancel you can cancel at any time from settings support it takes effect at the end of the period you have already paid for and you keep access until then cancelling takes the same handful of taps as subscribing did we are not going to make you write to us or sit through a retention offer where we sell memberships are sold in us dollars to customers in the united states and checkout asks for a united states billing address we are not set up to sell into the united kingdom or the european union and we would rather say so than take money we cannot properly account for refunds if you are unhappy write to support atelierjournals com within 14 days of a charge and we will refund it you do not have to give a reason and it applies to every customer we have after 14 days we will still read your email and we would rather sort something out than stand behind a clause founding members if you joined during the beta the palettes fonts and name styling you were given remain yours permanently along with the higher limits and the discount promised to you when you joined we made that promise while you were helping us test an unfinished product and these terms do not take it back founding status does not lapse cancelling a membership does not remove it and every time you subscribe again the founding discount applies to whatever the price is at that time founding status is not itself a membership features that require atelier pro such as the atlas travel map still need an active subscription 12 availability and warranties atelier is provided as is and as available to the fullest extent permitted by law we disclaim all warranties express or implied including merchantability fitness for a particular purpose and non infringement we do not warrant that the service will be uninterrupted error free or that data will never be lost see section 2 this is beta software and that is the honest position 13 limitation of liability to the fullest extent permitted by law we are not liable for indirect incidental special consequential or punitive damages or for lost profits lost data or lost goodwill arising from your use of atelier our total liability for any claim relating to atelier is limited to the greater of a the amount you paid us in the twelve months before the claim or b fifty us dollars some jurisdictions do not allow these limitations in which case they apply to you only as far as the law allows 14 ending things you can delete your account at any time from settings support account data doing so removes your account and your content as described in our privacy policy deletion is permanent we keep a marker that prevents the same google account from being used to sign in again and we cannot reverse that for you from inside the app a copy can persist in our automatic backups for up to seven days before it ages out as our privacy policy explains export anything you want to keep first we may suspend or terminate an account that breaks these terms that creates a legal risk or that we are required to act against except where the breach is serious or we are legally prevented we will give you notice and a chance to export your data first we may also discontinue atelier entirely if we do we will give you reasonable notice and a window to export everything
