disability and instead defers to the hra s definition article 1 of the crpd defines disability similarly as persons with disabilities include those who have long term physical mental intellectual or sensory impairments additionally the crpd defines its goal as follows to enable persons with disabilities to live independently and participate fully in all aspects of life states parties shall take appropriate measures to ensure to persons with disabilities access on an equal basis with others to the physical environment to transportation to information and communications including information and communications technologies and systems and to other facilities and services open or provided to the public both in urban and in rural areas these measures which shall include the identification and elimination of obstacles and barriers to accessibility shall apply to inter alia a buildings roads transportation and other indoor and outdoor facilities including schools housing medical facilities and workplaces and further expands on this in article 24 in the context of education states parties shall ensure that persons with disabilities are able to access general tertiary education vocational training adult education and lifelong learning without discrimination and on an equal basis with others to this end states parties shall ensure that reasonable accommodation is provided to persons with disabilities so we re all pretty clear on what legislatively is considered a disability and thus what falls under the scope of each of these per the bora everyone has the right to freedom from discrimination on the grounds of discrimination in the human rights act 1993 this again just means that anyone encompassed by the above definition has the right to be protected from discrimination based on disability the scope for where this protection exists is pretty broad as well in most if not all public spaces but for the purposes of this post i will highlight education and access to public places vehicles and facilities so ok we know then that disabilities of many kinds are protected by law in most public places let s pivot across to the building act 2004 which further defines both what constitutes a building under the act and also defines which buildings are subject to the accessibility portion of the act buckle up it s a long list a land sea and air passenger transport terminals and facilities and interchanges whether wholly on land or otherwise b public toilets wherever situated c banks d childcare centres and kindergartens e day care centres and facilities f commercial buildings and premises for business and professional purposes including computer centres g central regional and local government offices and facilities h courthouses i police stations j hotels motels hostels halls of residence holiday cabins groups of pensioner flats boarding houses guest houses and other premises providing accommodation for the public k hospitals whether public or private and rest homes l medical and dental surgeries and medical and paramedical and other primary health care centres m educational institutions including public and private primary public facilities the act in this case regulates quote the requirements relating to the use of buildings for example the requirement for a compliance schedule or the provisions relating to access to buildings by persons with disabilities and those buildings are anything listed above so most if not almost all places a disabled person could interact with in their daily life but what does the act actually require of buildings well that s actually basically covered exclusively by nzs 4121 2001 which sets out both mandated and recommended criteria for provision of disability access in buildings as defined by the building act so what exactly does the standard say well a lot really lol but in particular it explicitly defines how wheelchair access is provided which i am calling out because well that s my life and my example 3 the standard defines things like ramp gradient curbs doors and accessible routing for any building that is 1 defined by the act and 2 not exempt from meeting the standard i m not going to call out every single aspect in the standard but one particularly relevant example is their criteria for accessible routes as follows accessible route means a route that is usable by people with disabilities it shall be a continuous route that can be negotiated unaided by a wheelchair user walking device or by a person with a guide dog the route shall extend from the street boundary and car parking area to those spaces within the building required to be accessible to enable people with disabilities to carry out normal activities and processes within the building and for bathrooms in 10 2 1 accessible toilet facilities shall be provided on the main entry level to all buildings in addition in multi storey buildings additional accessible toilets shall be distributed evenly and throughout the building alternatively wherever toilets are provided at least one shall be an accessible toilet so like this is all pretty explicit and robust really and should be pretty straightforward to enforce on every level especially given the age of multiple of these there s no confusion just the detailing of exactly what rights we are provided with under the law right so now we reach my examples for those unaware i am a university student who is physically disabled and a wheelchair user i am also mad and deaf whether or not i am in my wheelchair i require an accessible bathroom my university is included in all of the mentioned acts and bills and my disabilities are protected here s some examples of how having poor enforcement of the legislation in addition to no dedicated protection of access needs in one of my classes the building has 3 lecture halls there are gendered bathrooms this building has no accessible bathrooms at all even within the gendered bathrooms themselves and even if there were that s actually a violation of the standard section 10 4 which states at least one all gender accessible toilet unit shall be provided that can be reached without going through an area reserved for one gender and is a standard broken by numerous places i access such as my local mall even barring that lacking an accessible toilet full stop violates my rights or perhaps we can touch on accessways there is no specifically accessible route onto the campus and my current route with the most ease of access also touched on in at least one of the linked bills acts violates a number of mandates set out by the standard the rest of campus is at best not much better and at worst actively dangerous to my safety let s use the fire and emergency evacuation legislation as an example which specifies that a place of safety must be a place from which the occupants are able to safely exit the building in one of my classes this year in a new building only a few years old the fire safety for wheelchair users are little concrete boxes just off the stairwell nice to have but oops now i m trapped in a burning building because i can t exit from there what about public transport well that one is covered by waka kotahi s rub which defines specific accessibility features required by public transport and in particular concerning buses for example in terms of the aisle there must be unimpeded access for a wheelchair and pram through the front wheel arches to at least the front edge of the rearmost set of priority seating or the rear of the wheelchair space wouldn t you know it plenty of our local buses do not comply with the rub there are a number of buses i physically cannot fit down the aisle of in my wheelchair finally just overall i have experienced discrimination for my disability ies in almost every single aspect including the many i didn t touch on here of my life and in situations where the law is extremely clear that my rights should be protected and that s for me a light skinned māori person without an intellectual disability or certain other marginalisation factors if in 2025 i cannot fucking access plenty of buildings in my city if in 2025 i cannot fucking access my university campus equal to my peers if in fucking 2025 parts of my local hospital aren t wheelchair accessible you cannot tell me that the
