avorite format for sharing new work and work in progress within the tj community we held a second boston workshop in 2016 subsequent workshops have been held in toronto canada osgoode hall law school york university twice hosted by prof shelley kierstead fort lauderdale florida shepard broad college of law nova southeastern university hosted by prof kathy cerminara miami gardens florida st thomas university college of law hosted by prof carol zeiner san juan puerto rico university of puerto rico school of law hosted by prof david wexler pet ideas in addition to welcoming the contributions of valued colleagues and dear friends i brought to this 2015 boston workshop two pet ideas of my own both of which i considered much needed advancements for the tj community in one of the aforementioned memos i set out ideas for the creation of a non profit organization dedicated to promoting the field of tj in the other i urged the need for a substantial law review article that would comprehensively assess the history and impact of tj going back to its 1987 founding by david wexler and bruce winick the proposal to create a tj non profit group got an enthusiastic response consequently a group of us would spend chunks of the next two years working to make this idea a reality in 2017 we launched the international society for therapeutic jurisprudence istj during a founding session at the international congress on law and mental health in prague czech republic although the istj was very positively received i would call it only a modest success at this juncture while it has succeeded in bringing together information and resources for the tj community it hasn t fully played the connective role that i had hoped for upon its founding much of this is due to the simple fact that the organization has no paid staff as a result the work of the group is left to a small group of volunteers most of whom are already busy academics practitioners and judges my workshop colleagues were less enthusiastic about assembling a law review article comprehensively summarizing the tj field eventually i opted to undertake the project on my own it proved to be a significant undertaking but the result was worth the effort in 2021 the university of miami law review would publish my tj magnum opus all 90 pages of it therapeutic jurisprudence foundations expansion and assessment this article if i may be immodest has attracted a genuine readership and succeeded in playing the educative role i had hoped it would serve between my own publications page and the journal s website it has been downloaded some 3 ooo times a very respectable showing for a scholarly law review article it also has been cited over 60 times in other articles books and graduate dissertations the value of conferences and workshops i am a huge fan of conferences workshops symposia seminars and other in person events for building intellectual communities stoking collaborative projects and forging summaries short commentaries and curated resources for those interested in learning about workplace bullying and related forms of workplace mistreatment workplace bullying in the legal profession not surprisingly the legal profession is among those vocations that report a lot of workplace bullying this problem is now getting needed attention from lawyer oversight commissions and bar associations illinois supreme court commission on professionalism the american bar association aba has highlighted this topic on several occasions last december it highlighted the work of the illinois supreme court commission on professionalism under the leadership of executive director erika harold the illinois commission launched one of the first large scale studies in the u s on bullying in the legal profession they partnered with the red bee group a chicago based consulting firm with experience conducting wide scale surveys for other legal organizations including the aba the report s authors and principals from the red bee group stephanie a scharf and roberta d liebenberg define bullying as inappropriate behavior intended to intimidate humiliate or control the actions of another person including verbal nonverbal or physical acts the resulting report found that nearly a quarter of the 6 000 illinois lawyers surveyed had experienced workplace bullying during a one year period particularly noteworthy the rates of bullying were highest among attorneys aged 25 to 35 female attorneys and attorneys with disabilities thirty nine percent of attorneys aged 25 to 35 reported having experienced bullying compared to 12 of attorneys aged 66 to 75 thirty eight percent of female attorneys said they experienced bullying compared to 15 of male lawyers similarly 38 of attorneys with disabilities said they experienced bullying compared to 23 of lawyers without a disability also bullied were 36 of middle eastern north african lawyers 35 of black african american lawyers 34 of hispanic lawyers 32 of multiracial lawyers and 28 of asian american lawyers compared to 23 of white lawyers who reported being bullied in addition 29 of lawyers who are gay lesbian or bisexual were the target of verbal bullying related to their sexual orientation while 3 of heterosexual lawyers were verbally bullied related to their sexual orientation american bar association earlier this year the american bar association journal ran a cover article by anna stolley persky pushed around bullying is a problem in the legal profession how can the cycle be broken membership walled featuring attorney and anti bullying advocate lauri rollings when lauri rollings moved from san francisco back to milwaukee and accepted an associate position at a midsize law firm she expected a certain amount of stress she was after all a litigator but she was blindsided by the bullying she encountered one partner rollings says would summon rollings to her office to berate her and complain about her failure to do specific parts of an assignment when the instructions hadn t been very clear bullying shouldn t be ignored or allowed says laurie rollings there was this one partner in particular who was hostile and aggressive and dressed me down rollings says it felt like she was setting me up to fail even worse rollings says was that other lawyers in the firm knew the partner was a bully but nobody did anything about it rollings says she then went to another firm where she experienced yet another partner with a reputation for bullying whom nobody seemed to confront she ended up experiencing anxiety depression insomnia heart pain and low self esteem all of which made it harder to do her work people in law firms need to understand that bullying shouldn t be ignored or allowed says rollings who now advises organizations about appropriate leadership and bullying prevention change starts with an awareness that this is happening she adds rollings experience with bullying at law firms is considered somewhat commonplace in the legal industry and it can have serious consequences in 2021 membership wall the aba invited me to contribute a short online piece 6 ways to fight workplace bullying in legal spaces here s what i contributed understand that lawyers have not necessarily been trained to work well with others some may not grasp the distinctions between assertive aggressive and abusive behaviors learn about workplace bullying and its destructive impacts on organizations and people the workplace bullying institute offer s excellent resources start with onboarding and orientation programs that message to new hires that everyone should be treated with dignity and respect include a section on bullying in employee handbooks and cover the topic in employee training programs use surveys and give feedback to help identify problems concerning bullying and related behaviors don t sweep bad reports under the rug consider coaching counseling and if necessary termination for abusive individuals even if they are your best litigators or key rainmakers international bar association in 2019 the international bar association published an extensive report on bullying and harassment in the legal profession the legal profession has a problem in 2018 the international bar association iba and market research company acritas conducted the largest ever global survey on bullying and sexual harassment in the profession nearly 7 000 individuals from 135 countries responded to the survey from across the spectrum of legal workplaces law firms in house barristers chambers government and the judiciary the results provide empirical confirmation that bullying and sexual harassment are rife in the legal profession approximately one in two female respondents and one in three male respondents had been bullied in connection with their employment one in three female respondents had been sexually harassed in a workplace context as had one in 14 male respondents this report provides a succinct analysis of that data to raise awareness about the nature extent and impact of the problem and inform the development of solutions nyt recommended
