head to a tail and do other things too like lichanos this morning i sat at my favourite old steam typewriter intending to write an assignment about pythagoras that man of roma had set me i had barely started when the doorbell rang i rushed downstairs in excitement for i knew it was a parcel i had been expecting there it was a large wooden crate i quickly signed for it and ripped the nails off it was a bumper consignment of lettuce i embraced an armful of it and returned upstairs munching happily away like an angus bull it was so delicious i could not stop eating it and like goldilocks i had soon eaten it all up the room began to rock and my head to spin where was i ada lovelace no archimedes no newton no gauss no kiss me hardy no ampersand duel with galois no oiler for a cardan joint no like a strange confession to some who are more used to using the word attorney or counsel when they speak of their lawyer in england and wales the word counsel usually means a barrister it may also be a surprise that in the eighteenth century england and wales also had other breeds of lawyers including attorneys and proctors solicitors acted in the chancery court attorneys in the common law courts and proctors in the ecclesiastical courts in the nineteenth century the word solicitor was applied by statute to cover all three terms at about the same time as the chancery court and the king s queen s bench and some of the ecclesiastical courts combined to form the high court it is specially protected and anyone who refers to themselves as a solicitor who has not been admitted to the roll commits a criminal offence it is important to remember that scotland retained its own legal system based as it is on roman law and not the common law and so its legal profession is entirely separate and always has been in 1969 when i was admitted there were only some 25 000 solicitors for a population of about 50 million whereas now there are about 150 000 for a population of about 60 million in those days the functions of solicitors were many and varied the average solicitor would involve himself in advocacy conveyancing transfer of property administration of deceaseds estates and litigation there was then an exclusive right to engage in those activities they were also tax advisers prepared wills and trusts and supplied general legal services as a result solicitors too were the principal holders of various public offices such as coroner shared with barristers and doctors clerks to the justices legal advisers to lay magistrates clerks to general tax commissioners laymen who decide tax cases and to a somewhat lesser extent company secretaries since none but a solicitor could head a legal department doing solicitors work town clerks who were normally solicitors seem to have entirely disappeared desmond heap the comptroller of the city of london who presided over the rebuilding of the city in the 60s was a solicitor whilst barristers had the exclusive right of audience in the higher courts they could not normally appear unless briefed by a solicitor yet it is not commonly known that some 90 of day to day advocacy was carried out by solicitors who had joint right of audience with barristers in the lower courts judicial appointments to the high court and above were the exclusive domain of barristers solicitors having to content themselves with appointments as registrars in the county court or as professionally qualified magistrates solicitors can form partnerships barristers are at present prohibited from doing so a majority of solicitors and barristers used to go into training immediately from school for a minimum of five years now a degree is mandatory in the days when i qualified solicitors were not allowed to advertise tout for business or pay for referrals when i established my practice those were the rules i had to play by or risk being struck off the roll increasing specialisation disdain for anything smacking of monopoly and a desire to require everyone to engage in the competition of the free market has completely changed the environment in which solicitors operate there are no restrictions on advertising some of our previously exclusive areas of activity are now shared with others referral fees are permitted and some solicitors have right of audience in the higher courts whilst barristers are now allowed to have direct professional contact with the general public without involving a solicitor all judicial appointments are now available to solicitors permitting referral fees has been a hotly debated matter profit in ordinary legal work is now extremely marginal and that work has become particularly onerous requiring expensive professional indemnity cover in england and wales unlike scotland it was not customary for solicitors to engage in the actual selling of property although there was nothing legally to prevent them from doing so it thus became a major decision for the practice now run by one of my sons and his friend to expand into this area and take advantage of the further sources of income available specialisation had already narrowed their field and there is amongst solicitors a resistance to doing this kind of work it was a difficult choice but they decided to take the plunge they could no longer rely on referrals by non solicitor estate agents so there was some risk involved they had never paid referral fees and they did not wish to start they preferred to retain their independence and continue to do the work for which they had been trained the venture is a success but i do not envy them i have much nostalgia for former times i am no longer fully involved but continue to maintain my practising certificate which has to be taken out yearly and for which i have to try to keep up with my reading i am fortunate in that most local solicitors continue working well into their seventies most young solicitors preferring the city or similar and its financial rewards the pressures on the high street solicitor have seriously curtailed access to justice for ordinary people and the decline in the rule of law is no coincidence city solicitors who for the most part do not have private clients and have been largely immune from these changes are now suffering the effects of the recession my other son also a solicitor is there and is ok though my daughter is on the it desk of another firm of solicitors so you can see my family s investment in the law is pretty high well today is my little granddaughter s birthday and glenys and i are off to see her this afternoon posted in you know it was 1961 the year he was due to retire i carried her books home after school one day there were a lot of them and i dropped one who s night zee i asked nietzsche he s a teacher she said slapping the book back on the pile don t drop any more i followed her like a lost sheep she led me up the garden path through the front door and directed me where to place the books pointing impatiently i turned dejected and the door slammed behind me at least mr keane would be reading the pit and the pendulum tomorrow for a treat i d seen the movie and couldn t wait she always deliberately made life difficult for poor old mr keane i wasn t sure he d survive it all she d sprawl everywhere yawn gaze out of the window and pretend she hadn t heard him call her name he never corrected her that day she d gathered us all together during the lunch recess we always did what she said i m really going to get him this time she declared when i cough twice slam all your math books shut i glanced up towards the classroom mr keane was there at the window watching wiping away a tear so there we all were the next day in the classroom waiting for the signal it came there was a loud bang poor old mr keane nearly jumped out of his skin she was triumphal he was terribly cross at first who can blame him when he d got over the agony of the first shock a smile of delight stretched mr crotchety after the last post really upset me i don t think he liked me mentioning the full stop in his name we were getting on so well i stomped downstairs where glenys was painting the ceiling she could knock spots off michelangelo if she really tried i scowled at her what s up with you then don t you like me doing this she peered down at me from the top of the ladder brush in hand go and get us a cup of tea into the kitchen i went obediently i couldn t find the kettle where s the kettle where you left it oh yes sorry where are the teabags in the usual place oh yes sorry i managed to find the tap and the on switch and after a fair interval emerged with two mugs of tea one of which i placed on the floor beside the ladder the other i carried without another word to a quiet room i put on the gramophone the strains of karajan conducting the brook movement for the lso scratched and worn filled all creation beethoven knew all i ever pretended to know and i still learn afterwards i there i took the waters the man took my ten pence lent over the railing with a long ladle filled a glass of water and handed it to me i drank it to the dregs but didn t feel any better actually i felt rather worse so i crossed the road to the bookshop just to browse you understand i only had 20 pence left outside was a dusty cardboard box full of tattered paperbacks marked 3 for 10 pence i poked about in it there were three large easy to read novels set in tudor england no i d read those then i landed on a small slim battered scrap that had lost its covers wittgenstein it said now there s a name to conjure with this would be my passport to that elite company i aspired to i saw that the author was another famous name i reached into my pocket pulled out 10 pence grabbed love and an electric blanket by henrietta spark and the seventh hole by septimus tel de wyf pushed past a serious looking hospital orderly in a long raincoat paid my money and made tractatus for home with my three purchases in time for the daily soap opera i fingered wittgenstein anxiously i read the words the brown book and opened it wider and scanned a few paragraphs i could make neither head nor tail of it perhaps if i started near the beginning prime numbers caught my eye proof that there is an infinite number of them pure euclid i remembered from my schooldays what a prime number is however hard you try you can t make equal piles of a prime number of objects unless of course you make one pile of all of them quite a mystery really i read a bit more closely take any prime number i paraphrase
